Family & domestic violence leave | Fair Work Australia

Did you know that ALL employees, including part-time and casual employees, are able to take 5 days of ‘family and domestic violence leave’ each year?

The leave is unpaid, and you may also be entitled to other paid or unpaid leave under your own agreement or award.

You also don’t have to ‘build-it-up’, you can take the days you need straight away, which could be important if you’ve started a new role to help you escape a violent situation at home.

You can use the leave for formal things, like attending court hearings and speaking with the police, or for informal things like making arrangements for somewhere to live, arranging a new phone or moving house.

You can take it however you need, and if your employer agrees you can take less than one day at a time. In fact, flexible working arrangements could help you to manage the situation and reduce any affects on your performance at work, so ask your employer if it’s possible for you to adjust your hours or change your work routine if you need.

You don’t need to ask permission, but you do need to let your employer know as soon as possible. You also need to let them know how long you expect to be away, and they have the right to request evidence such as court documents, a statement from a support service, or a stat dec.
